1. ขอบเขต

ข้อกำหนดนี้ใช้กับเว็บไซต์ [โดเมน] และเกม เครื่องมือ และ Digital Experiments ที่ดำเนินการภายใต้ NYN LAB ซึ่งดำเนินการโดย [ชื่อผู้ดำเนินการ/ชื่อนิติบุคคล] การเข้าใช้บริการถือว่าผู้ใช้ตกลงใช้บริการภายใต้ข้อกำหนดนี้และนโยบายความเป็นส่วนตัวของ NYN LAB

2. ลักษณะของบริการ

NYN LAB เป็นพื้นที่สำหรับเกมและ Digital Experiments บริการบางส่วนอาจอยู่ในระยะทดลองและอาจถูกปรับ Gameplay, เปลี่ยน Score system, Reset leaderboard, เพิ่มหรือลบฟังก์ชัน, ปิดชั่วคราว, เปลี่ยน URL หรือนำออกจากบริการ เพื่อการพัฒนา ความปลอดภัย หรือเหตุผลทางธุรกิจที่สมเหตุสมผล เราไม่รับประกันว่า Experiment ทุกชิ้นจะคงอยู่ตลอดไป

3. บริการช่วงเริ่มต้น

• เล่นได้โดยไม่สมัครบัญชี
• ไม่มีระบบ Public UGC
• ไม่มี Marketplace
• ไม่มีการซื้อหรือ Subscription จาก NYN LAB โดยตรง
• อาจใช้ Anonymous ID และ Browser Storage
• อาจมี Score, Replay, Share และ Analytics

หากเราเพิ่มระบบสมาชิก UGC หรือบริการชำระเงินในภายหลัง เราอาจออกข้อกำหนดเพิ่มเติมหรือปรับปรุง Terms นี้

4. ผู้ใช้ที่เป็นเด็กหรือเยาวชน

หากผู้ใช้ยังไม่มีความสามารถตามกฎหมายในการยอมรับข้อกำหนดด้วยตนเอง ควรใช้บริการภายใต้การดูแลหรืออนุญาตของผู้ปกครองหรือผู้แทนโดยชอบด้วยกฎหมายตามที่กฎหมายที่เกี่ยวข้องกำหนด

5. สิทธิในการใช้งาน

NYN LAB อนุญาตให้ผู้ใช้เข้าถึงและเล่นเกมหรือใช้ Experiment เพื่อการใช้งานตามปกติของบริการ สิทธินี้เป็นสิทธิแบบจำกัด ไม่ผูกขาด และไม่สามารถโอนให้บุคคลอื่นได้ การใช้เว็บไซต์ไม่ได้โอนกรรมสิทธิ์ในเกม Code, Character, Artwork, Audio, Branding หรือทรัพย์สินทางปัญญาของ NYN LAB ให้ผู้ใช้

6. ทรัพย์สินทางปัญญา

เว้นแต่ระบุไว้เป็นอย่างอื่น NYN LAB หรือเจ้าของสิทธิที่เกี่ยวข้องเป็นเจ้าของหรือมีสิทธิใช้ใน Source code, Artwork, Character, Animation, Audio, UI, Logo, Branding, Written content, Original game assets และ Website design ห้ามนำสิ่งเหล่านี้ไปคัดลอก จำหน่าย แจกจ่าย หรืออ้างว่าเป็นผลงานของตนเองโดยไม่ได้รับอนุญาต เว้นแต่กฎหมายอนุญาต

7. พฤติกรรมที่ห้าม

ห้ามใช้ NYN LAB เพื่อเข้าถึง Admin หรือระบบที่ไม่ได้รับอนุญาต, โจมตีหรือรบกวน Server, DDoS, ส่ง Malware, Spam, Phishing, Fraud, ขโมยข้อมูล, หลีกเลี่ยงมาตรการ Security, พยายามเข้าถึง Secret หรือ Credential, ส่งข้อมูลปลอมไปยัง API, ใช้ Bot หรือ Automation เพื่อทำคะแนนโดยไม่ได้รับอนุญาต, ดัดแปลงข้อมูลเพื่อปลอม Score, ใช้ Bug หรือ Exploit เพื่อทำลายบริการหรือสร้างความได้เปรียบที่ไม่เป็นธรรม หรือใช้บริการเพื่อกระทำผิดกฎหมายหรือละเมิดสิทธิบุคคลอื่น

8. คะแนนและ Leaderboard

Score และ Leaderboard มีไว้เพื่อความบันเทิง เว้นแต่กิจกรรมใดระบุกติกาอื่นไว้อย่างชัดเจน NYN LAB อาจตรวจสอบ ลบ Reset หรือไม่นับคะแนนที่มีเหตุอันสมควรให้เชื่อว่าเกิดจาก Cheat, Bot, Script, Bug, Exploit, API abuse, Technical error, การแก้ไข Client หรือการส่งข้อมูลเท็จ

Score ไม่มีมูลค่าเป็นเงินสดและไม่ก่อให้เกิดสิทธิในการรับเงินหรือรางวัล เว้นแต่กิจกรรมที่ประกาศอย่างเป็นทางการกำหนดไว้เป็นอย่างอื่น

9. Guest Data

เนื่องจากบริการช่วงแรกไม่จำเป็นต้องใช้บัญชี ข้อมูลบางประเภทอาจอยู่ใน Browser ของผู้ใช้เท่านั้น หากผู้ใช้ล้าง Browser data, เปลี่ยน Browser, เปลี่ยนอุปกรณ์ หรือใช้ Private/Incognito Mode ข้อมูลบางส่วนอาจสูญหาย NYN LAB ไม่รับประกันว่าจะสามารถกู้คืน Guest progress ได้

10. Share

เกมบางเกมอาจมีปุ่ม Share หรือสร้าง URL/ข้อความสำหรับแชร์ ผู้ใช้เป็นผู้ตัดสินใจว่าจะส่งข้อมูลดังกล่าวไปยังบุคคลอื่นหรือ Platform ใด เมื่อผู้ใช้แชร์ผ่าน Third-party platform การใช้งาน Platform ดังกล่าวอยู่ภายใต้ Terms และ Privacy Policy ของผู้ให้บริการนั้น

11. โฆษณา

NYN LAB อาจสร้างรายได้จากโฆษณา เช่น Display advertising, Interstitial advertising, Rewarded advertising และ Sponsorship เมื่อมี Rewarded advertising จะถูกนำเสนอเป็นทางเลือกและจะแจ้งรางวัลหรือผลที่ได้รับก่อนผู้ใช้ตัดสินใจรับชม

โฆษณาและเว็บไซต์ของผู้ลงโฆษณาอาจอยู่ภายใต้ข้อกำหนดของบุคคลภายนอก การแสดงโฆษณาไม่ได้หมายความว่า NYN LAB รับรองทุกคำกล่าวหรือผลิตภัณฑ์ของผู้โฆษณา

12. Third-party Services

NYN LAB อาจใช้หรือเชื่อมต่อบริการของบุคคลภายนอก เช่น Cloud, Analytics, Advertising หรือ Social Sharing เราไม่ควบคุมบริการภายนอกทั้งหมด และบริการเหล่านั้นอาจอยู่ภายใต้ Terms และ Privacy Policy ของตนเอง

13. ความพร้อมของบริการ

เราพยายามดูแลให้ NYN LAB ทำงานอย่างเหมาะสม แต่ไม่สามารถรับประกันว่าเว็บไซต์จะทำงานตลอดเวลา ไม่มี Bug ไม่มี Downtime รองรับทุก Browser หรืออุปกรณ์ ไม่มี Data loss หรือไม่ได้รับผลกระทบจาก Internet outage หรือ Cyberattack เราอาจปิดบริการชั่วคราวเพื่อ Maintenance, Security หรือ Update

14. เกมและ Experiment

เกมอาจเปลี่ยนแปลงระหว่างการพัฒนา เราอาจปรับความยาก Rules, Physics, Score calculation, Game balance, Assets, Levels หรือ Features เพื่อปรับปรุงเกมหรือแก้ปัญหา การเปลี่ยนแปลงดังกล่าวอาจทำให้คะแนนหรือผลลัพธ์ในเวอร์ชันใหม่แตกต่างจากเดิม

15. การรับประกัน

ภายใต้ขอบเขตที่กฎหมายอนุญาต บริการจัดให้ตามสภาพและตามความพร้อมใช้งาน เราไม่รับประกันว่าผู้ใช้จะได้ Score ตามที่ต้องการ คะแนนจะอยู่ถาวร ทุกเกมจะคงอยู่ตลอดเวลา เกมจะทำงานเหมือนกันทุกอุปกรณ์ หรือบริการจะไม่มีข้อผิดพลาด ข้อความนี้ไม่ตัดสิทธิหรือการรับประกันที่กฎหมายบังคับให้ผู้บริโภคต้องได้รับ

16. ขอบเขตความรับผิด

ภายใต้ขอบเขตสูงสุดที่กฎหมายอนุญาต NYN LAB จะไม่รับผิดสำหรับความเสียหายทางอ้อมหรือความสูญเสียที่อยู่นอกเหนือการควบคุมที่สมเหตุสมผลของเรา เช่น ความคืบหน้า Guest สูญหายหลังล้าง Browser, Network outage, Browser incompatibility หรือ Third-party service outage ไม่มีข้อกำหนดใดใน Terms นี้ตัดหรือจำกัดความรับผิดในกรณีที่กฎหมายไม่อนุญาตให้ตัดหรือจำกัด

17. ความปลอดภัย

หากผู้ใช้พบช่องโหว่ด้าน Security โปรดแจ้ง nynlabplaylearn@gmail.com โปรดอย่าเข้าถึงข้อมูลของผู้อื่น ทำลายข้อมูล รบกวนบริการ หรือเปิดเผยรายละเอียดช่องโหว่ที่อาจทำให้ผู้ใช้เกิดอันตรายก่อนที่เราจะมีโอกาสตรวจสอบและแก้ไขอย่างเหมาะสม

18. การจำกัดการใช้งาน

เราอาจจำกัดหรือบล็อกการใช้งานบางส่วนเมื่อมีเหตุผลสมควร เช่น การโจมตีระบบ, Cheat อย่างต่อเนื่อง, Spam, Fraud, Security abuse, การละเมิดกฎหมาย หรือการละเมิด Terms อย่างร้ายแรง โดยจะใช้มาตรการตามความเหมาะสมกับความเสี่ยง

19. การเปลี่ยน Terms

Terms อาจถูกปรับเมื่อ NYN LAB เพิ่มหรือเปลี่ยนบริการ หากการเปลี่ยนแปลงมีสาระสำคัญ เราจะใช้วิธีแจ้งที่เหมาะสม วันที่แก้ไขล่าสุดจะแสดงไว้ด้านบน

20. กฎหมายที่ใช้บังคับ

Terms นี้อยู่ภายใต้กฎหมายไทย อย่างไรก็ตาม ข้อกำหนดนี้ไม่มีเจตนาตัดสิทธิผู้บริโภคหรือสิทธิอื่นที่กฎหมายบังคับในประเทศหรือภูมิภาคของผู้ใช้กำหนดให้ไม่สามารถสละได้

1. Scope

These Terms apply to [Domain] and the games, tools, and digital experiments operated as part of NYN LAB by [Legal name / company name]. By using the Service, users agree to use it in accordance with these Terms and the NYN LAB Privacy Policy.

2. Nature of the Service

NYN LAB is a platform for browser-based games and digital experiments. Some experiments may be experimental and may be modified, rebalanced, reset, temporarily unavailable, moved, updated, or removed for development, security, operational, or reasonable business purposes. We do not guarantee that every experiment will remain available indefinitely.

3. Initial Launch Features

• Does not require account registration
• Does not provide public UGC publishing
• Does not operate a marketplace
• Does not offer direct purchases or subscriptions
• May use anonymous identifiers and browser storage
• May provide scoring, replay, sharing, and analytics

If accounts, UGC, payments, or other material services are introduced, additional or updated terms may apply.

4. Minors

Users who are not legally able to agree to these Terms on their own should use the Service only with appropriate involvement or permission from a parent or legal guardian where required by applicable law.

5. License to Use the Service

NYN LAB grants users a limited, non-exclusive, non-transferable right to access and use the Service for its intended purposes. Using the Service does not transfer ownership of NYN LAB games, code, characters, artwork, audio, branding, or other intellectual property.

6. Intellectual Property

Unless otherwise stated, NYN LAB or its applicable licensors own or are authorized to use source code, artwork, characters, animations, audio, user interfaces, logos, branding, written content, original game assets, and website design. Users may not copy, sell, redistribute, or falsely claim ownership of such materials without authorization, except where applicable law permits otherwise.

7. Prohibited Conduct

Users must not use NYN LAB to access unauthorized administrative systems, attack or disrupt servers, conduct DDoS attacks, distribute malware, spam, phish, commit fraud, steal information, circumvent security controls, obtain secrets or credentials, send fraudulent API data, use unauthorized bots or automation to generate scores, manipulate game data to falsify scores, exploit bugs to damage the Service or obtain unfair advantages, or use the Service for unlawful activities or infringement of others' rights.

8. Scores and Leaderboards

Scores and leaderboards are provided for entertainment unless specific official rules state otherwise. NYN LAB may investigate, remove, reset, or disregard scores reasonably believed to result from cheating, bots, scripts, bugs, exploits, API abuse, technical errors, client modification, or false submissions. Scores have no cash value and do not create a right to payment or prizes unless an officially announced promotion expressly states otherwise.

9. Guest Data

Because the initial Service does not require user accounts, some information may exist only in the user's browser. Clearing browser data, changing browsers or devices, or using private browsing may result in loss of local progress. NYN LAB does not guarantee recovery of guest progress.

10. Sharing

Certain games may provide sharing functionality or generate shareable links or text. Users decide whether and where to share such information. Use of a third-party sharing platform is governed by that platform's own terms and privacy policy.

11. Advertising

NYN LAB may generate revenue from display advertising, interstitial advertising, rewarded advertising, and sponsorship. Where rewarded advertising is offered, it will be optional and the relevant reward or effect will be described before the user chooses to view the ad. Third-party advertisements and advertiser websites may be subject to their own terms. Displaying an advertisement does not mean that NYN LAB endorses every statement, product, or service offered by an advertiser.

12. Third-party Services

NYN LAB may use or interact with third-party cloud, analytics, advertising, or sharing services. We do not control all third-party services, and their own terms and privacy policies may apply.

13. Service Availability

We aim to keep NYN LAB operating reliably but cannot guarantee that the Service will always be available, be free from bugs, have no downtime, work on every browser or device, never experience data loss, or be unaffected by Internet outages or cyberattacks. The Service may be temporarily unavailable for maintenance, security, or updates.

14. Games and Experiments

Games may change during development. We may modify difficulty, rules, physics, scoring, balance, assets, levels, or features to improve the Service or address problems. Updates may cause scores or results to differ between versions.

15. Disclaimers

To the extent permitted by applicable law, the Service is provided on an “as available” basis. We do not guarantee that users will achieve a particular score, scores will remain indefinitely, every game will remain available, games will perform identically on all devices, or the Service will be error-free. Nothing in these Terms excludes mandatory consumer warranties or rights that cannot legally be excluded.

16. Limitation of Liability

To the maximum extent permitted by applicable law, NYN LAB will not be responsible for indirect losses or losses outside our reasonable control arising from matters such as guest progress lost after browser data is cleared, network failures, browser incompatibility, or third-party service outages. Nothing in these Terms excludes or limits liability where applicable law does not allow such exclusion or limitation.

17. Security

If you discover a security vulnerability, please contact nynlabplaylearn@gmail.com. Please do not access other users' information, destroy data, disrupt the Service, or publicly disclose harmful vulnerability details before we have had a reasonable opportunity to investigate and address the issue.

18. Restricting Access

We may restrict access where reasonably necessary in response to system attacks, persistent cheating, spam, fraud, security abuse, illegal activity, or serious violations of these Terms. Measures will be proportionate to the relevant risk where reasonably practicable.

19. Changes to these Terms

We may update these Terms as NYN LAB changes or expands. Material changes may be communicated using an appropriate notice. The latest revision date will appear at the top of this document.

20. Governing Law

These Terms are governed by the laws of Thailand. However, nothing in these Terms is intended to remove mandatory consumer or other rights that cannot lawfully be waived under the laws applicable to a user.

21. Contact

Language

These Terms are provided in Thai and English for convenience. In the event of a material inconsistency, the Thai version will govern to the extent permitted by applicable law, without limiting mandatory consumer rights under applicable law.
